Rebate Voucher Redemption Terms & Conditions

            1.     All “Buy to Save” rebates will be awarded to the customers in specially issued Rebate Vouchers from Tomher Industrial Sdn Bhd. All rebate vouchers are only valid with official company’s stamp which indicates the date of expiration.

2.     The rebate amount is based on the purchase cycle which starts from 1^st Aug to 31^st July every year. The rebate vouchers will be issued within two months following the close of a rebate season however the exact date of issue is at the discretion of Tomher Industrial Sdn Bhd. 

3.     Tomher “Buy to Save” Rebate Vouchers are exclusive only for use of the Priority! Club Card Member. 

4.     By joining Priority! Club, Tomher Industrial Sdn Bhd may use your personal information to contact you from time to time and/ or to send advertisements about events, products and services which we think you are likely to be interested in. The Privacy Policy detailed on this section also forms a part of these Terms and Conditions. 

5.     Tomher Rebates will be issued to members in the form of “Buy to Save” Rebate Voucher. “Buy to Save” Rebate Voucher can only be redeemed on full price purchases; cannot be used in conjunction with any other offer; cannot be redeemed for cash and cannot be used to make a payment on behalf. Other Terms and Conditions may apply.

6.     “Buy to Save” Rebate Voucher will not be replaced if stolen or lost. 

7.     It is the member’s responsibility to inform Tomher of any changes to personal details. Tomher accepts no responsibility for members not receiving “Buy to Save” Rebate Voucher, invites or any other promotional material, if incorrect details are provided, or Tomher are not notified of any change of detail. Tomher also accepts no responsibility for late, lost or misdirected correspondence resulting from circumstances outside Tomher control. 

8.     Tomher reserves the right, at any time without notice, to: 
(a) suspend, terminate or vary the Priority! Club Member program; 
(b) change the terms and conditions of the Priority! Club Member program; and 
(c) terminate any individual’s membership or refuse to issue any individual a membership in its absolute discretion. 

9.     Tomher Industrial Sdn Bhd and all its subsidiary companies shall not be liable for any loss or damage suffered by members resulting from such suspensions, terminations, variations or change as set out in clause 8, or arising from the Priority! Club Member program, except for any liability which can not be excluded by law. 

10.   Strictly one voucher valid per transaction. Valid for a limited time only as marked on the issued voucher.

11.   In the event where only deposits were received, rebates will only be applicable to the amount of the deposit paid and the remaining rebates shall be awarded when the final balance has been paid.

12.   Tomher “Buy to Save” Rebate Vouchers will be awarded, on a basis to be specified by Tomher from time to time, according to the amount of qualifying purchases during the specified period.

13.   If you do not redeem your rebate vouchers before or on the date of expiry, the vouchers will be deemed invalid and automatically terminated in our record.

            14.   Reward points accumulated on separate accounts cannot be combined on redemption.

 

            15.   All rebate vouchers are not transferable and are not exchangeable for cash. Any request to extend the original expiration date imprinted on the rebate vouchers will not be entertained.

 

            16.   You need to show physically the original “Buy to Save” rebate vouchers during point of purchase in order to redeem the rebate amount on your purchase. Failure to do so will not qualify you for any rebate discount. In the event where purchase cannot be done physically at our premises, you can still redeem your rebate discount by providing us the unique voucher numbers imprinted on the rebate vouchers but it is mandatory to fax or email us your rebate voucher for the rebate to be effective.

 

            17.   Our system will indicate if your rebate voucher has been previously redeemed and our record shall be final and the sole discretion of Tomher Industrial Sdn Bhd.

18.   Members may terminate their membership to the Priority! Club Member program at any time, without reason, by giving written notice to:

Interpretation and Modification of Rules; Limitation of Liability; Indemnity

We have the sole right and discretion to interpret and apply the Rules and Terms of Use, as may be modified from time to time. All decisions by us with respect to the Rules and Terms of Use are final. We reserve the right, in our sole discretion, to modify these Rules, including, without limitation, to impose membership time limits, to change the ways in which you can earn rebates, to change the amount of rebates you can earn in a given period or for a given promotion, and to add, remove and otherwise change point values, rewards and reward levels, in all instances at any time, without prior notice and without any obligation or liability to you. The accumulation of points does not necessarily entitle you to any rights with respect to points or rewards; in accumulating rebates, you may not rely upon the availability of any reward or reward level.

 

The Program, including, without limitation, the awarding of points and rewards, is void where prohibited by law. Other restrictions or exclusions may apply that are not set forth in these Rules. All rewards are used by you at your sole risk and responsibility. Tomher Industrial Sdn Bhd and its subsidiaries, owners, stockholders, franchisees, affiliates, agents, and their respective directors, officers, employees, successors and assigns (collectively, "Program Entities") assume no liability or responsibility, financial or otherwise, for any damage, loss or injury resulting from or arising out of your participation in the Program or acceptance or use of any reward. In addition, you agree to indemnify and hold harmless the Program Entities from any and all liability resulting or arising from the Program, and to release all rights to bring any claim, action or proceeding against the Program Entities. You further hereby acknowledge that the Program Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Program or acceptance or use of any reward.
